Please read these Terms and Conditions ("Terms") carefully before using FlameFeed.ai (the "Service") operated by FlameFeed.ai ("we", "us", or "our").

By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Service Description

FlameFeed.ai is an AI-powered content creation platform that allows users to generate videos, images, scripts, newsletters, blog posts, and social media content using artificial intelligence. The Service also includes tools for scheduling and publishing content to social media platforms.

2. Eligibility and Account Registration

  • You must be at least 18 years old to use the Service.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@flamefeed.ai if you suspect unauthorised access.
  • One person or entity may not maintain more than one free account.

3. Credits and Payments

Credits System

The Service operates on a credit-based system. Credits are consumed when you generate content. The credit cost of each operation is displayed before you confirm generation. Credits are non-refundable once consumed.

Subscriptions and Purchases

  • Subscription plans are billed in advance on a monthly or annual basis.
  • Prices are displayed in USD and are exclusive of applicable taxes.
  • We reserve the right to change pricing with 30 days' notice.
  • Unused credits do not roll over between billing periods unless stated otherwise in your plan.

Refunds

Subscriptions may be cancelled at any time, effective at the end of the current billing period. We do not provide refunds for partial subscription periods or unused credits, except where required by applicable law.

4. AI-Generated Content

Ownership

Subject to these Terms and payment of applicable fees, you own the content you generate using the Service. We do not claim ownership over your outputs.

Licence to Us

By submitting prompts, uploads, or other inputs to the Service, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing the Service to you.

Accuracy and Quality

AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, editing, and approving any content before publishing or distributing it. We make no warranties regarding the accuracy, legality, or fitness for purpose of AI-generated outputs.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, obscene, or hateful.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Generate non-consensual intimate imagery (NCII) or deepfakes of real individuals without their consent.
  • Produce content that infringes the intellectual property rights of third parties.
  • Spam, harass, or harm other individuals.
  • Attempt to circumvent usage limits, access controls, or the credit system.
  • Use automated scripts, bots, or other means to access the Service in an abusive manner.
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform.
  • Resell or sublicense the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these rules, without notice and without refund.

6. Third-Party Platforms and Integrations

The Service integrates with third-party platforms including Instagram and other social media networks. Use of these integrations is subject to the applicable platform's own terms of service. We are not responsible for any actions taken by third-party platforms, including content removal, account suspension, or policy changes.

7. Intellectual Property

All platform code, design, branding, and underlying AI models remain the intellectual property of FlameFeed.ai or its licensors. You may not copy, modify, or distribute any part of the platform without our written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAMEFEED.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless FlameFeed.ai and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

Either party may terminate the agreement at any time. You may close your account via Settings. We may suspend or terminate your access immediately if you breach these Terms, without liability to you. Upon termination, your right to use the Service ceases and your data will be handled per our Privacy Policy.

13. Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country of residence provide otherwise.
